Quashing the proceedings, Justice Tahaliyani observed that Advani's relation with Khanna was not of the nature of marriage and hence, she cannot seek relief under the provisions of Domestic Violence Act.

The Bombay High Court on Wednesday had reserved its order on the petitions filed by Dimple, Twinkle and Akshay seeking to quash proceedings initiated against them by the late actor's alleged live-in partner Advani, who had had claimed that she was evicted from Khanna’s suburban bungalow Aashirwad after his death and had sought monthly maintenance and a three-bed room flat in Bandra Senior counsels Shirish Gupte and Mahesh Jethmalani, appearing for the family, had argued that Advani cannot claim relief under the DV Act and maintenance as Kapadia and her family were not living with Rajesh Khanna or Advani.

Twinkle’s lawyer advocate Birendra Saraf argued that Advani had no right to get a copy of the will as she was not a family member, nor was she a legal heir.

Her claim was based on a complaint filed under the Domestic Violence Act and that did not give her the right to secure a copy of Khanna’s will.

In a relief to late actor Rajesh Khanna's wife Dimple Kapadia, daughter Twinkle Khanna and son-in-law Akshay Kumar, the Bombay High Court quashed a complaint of domestic violence lodged against them by his alleged live-in partner Anita Advani.

The High Court however earlier this year had discharged Rinkie from the case after observing that she was married and lived in Kolkata and hence offence under Domestic Violence Act cannot be made out against her.

Advani, who claims to have lived in with Khanna at his iconic suburban bungalow Ashirwad during the last two years of his life and looked after him, has challenged genuineness of the will, saying that he was not in the position to sign it at the time due to ill-health.
